1. Acceptance
These Terms of Service ("Terms") form a binding agreement between you and DressedByAI, a service operated by DressedByAI, a sole proprietor based in India (Jaipur, India). By creating an account or using the service you accept these Terms.
2. Eligibility
You must be at least 18 years old (or the age of majority in your country, if higher) to use DressedByAI. By using the service you confirm you meet this requirement.
3. Account & security
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us at support@dressedbyai.com if you suspect unauthorised access.
4. Acceptable use
- Do not upload content you don’t have rights to.
- Do not upload images of other people without their consent.
- Do not use the service for unlawful, harmful, or harassing purposes.
- Do not attempt to reverse-engineer, scrape, or abuse the service.
- Do not bypass usage limits or quota systems.
5. AI-generated content
DressedByAI uses third-party AI models (currently OpenAI) to analyse photos and generate outfit suggestions and look previews. AI output may be inaccurate, incomplete, or unexpected. You are responsible for reviewing AI outputs before relying on them. You retain rights in your inputs and, subject to applicable laws and the underlying AI provider’s usage policy, are granted a licence to use the outputs generated for you. We and our providers may use your inputs (including uploaded photos) and generated content to train, fine-tune, and improve AI and machine-learning models.
6. Subscriptions and billing
Paid plans (e.g. "Pro") are billed monthly or annually as described on the Pricing page. Once payments are enabled, billing will be processed by our third-party payment processor. The processor’s identity and terms will be disclosed at checkout, and by subscribing you will also agree to those terms. Subscriptions renew automatically until you cancel.
7. Credits and refunds
Credit packs purchased separately allow additional look-preview generations. Used credits are non-refundable. Refund eligibility is described in our Refund Policy. Refund requests will be processed via our payment processor.
8. Intellectual property
The DressedByAI service, software, name, and branding are owned by DressedByAI. These Terms do not transfer ownership of any DressedByAI intellectual property to you.
9. User content
You retain ownership of clothing photos, profile photos, and other content you upload ("User Content"). You grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, process, reproduce, modify, display, and otherwise use your User Content for any purpose connected with our business, including operating and improving the service, advertising and marketing, training and improving AI and machine-learning models, and sharing, transferring, or selling your User Content (and data derived from it) to third parties. You confirm you have the rights necessary to upload your User Content and to grant this licence.
10. Service availability
DressedByAI is available worldwide. Some features depend on third-party services (e.g. OpenAI, Cloudinary, our payment processor) and may be unavailable from time to time. You are responsible for compliance with any local laws applicable to you.
11. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or use the service abusively. On termination, paid subscriptions remain active until the end of your current billing period unless terminated for cause.
12. Disclaimers
DressedByAI is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. Outfit suggestions and look previews are for informational and personal use only.
13. Limitation of liability
To the fullest extent permitted by law, DressedByAI is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data. Our aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) GBP 50.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts of Jaipur, India have exclusive jurisdiction over any dispute, subject to the consumer-rights carve-out below.
15. Mandatory consumer rights
Nothing in these Terms limits any non-derogable consumer-protection rights you have under the law of your country of residence, including (for UK users) under UK consumer law and (for EU users) under EU consumer law. If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence under those laws.
16. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after a change constitutes acceptance of the updated Terms.
